Guideline for submission to FSE

The FSE has defined areas of interest which are reflected in the definition of the business of the FSE. 

When making a submission kindly ensure that your issue falls within the business of the FSE. 

Indicate clearly which of the following issues are applicable on your submission:

Represent the interests of ordinary people in understanding and defending their constitutional rights, which specifically include Section 24 of the constitution by having an environment that,

                                                               i.      is not harmful to health and well being

                                                             ii.      is protected for present  future generations, and

                                                            iii.      by implementing fully the legislation and other measures available to,

·         prevent pollution and ecological degradation

·         promote conservation

·         ensure ecological sustainable development and use of natural resources, and

·         promote justifiable social and economical development.

 And Section 33 of the Constitution by having a procedural process whereby administrative decisions are;

·         lawful, reasonable and  fair to all parties; and

·         supplies written reasons to adversely affected parties.

Additionally, when bringing an Issue under the attention of the FSE:

1)      The submission must be two hard copies, indexed, filed or otherwise bound.

2)      The submission must contain copies of all relevant information and documentation.

3)      The submission must be in the prescribed manner as far as possible.

4)      The prescribed manner is broadly in the same outline as a founding affidavit.

(1)    The submission should contain:

                                                               i.      All relevant licensing, rights and reference numbers as well as the full registered name of the company(ies) involved

                                                             ii.      Copies of the Environmental Management Programme Report (EMPR), Environmental Management Plan (EMP), Environmental Impact Assessment (EIA), Integrated Water Use Licence Application (IWULA), Integrated Water and Waste Management Plan (IWWMP) or any other similar documents.

                                                            iii.      A table of content

                                                           iv.      An executive summary of no more than 2 pages

                                                             v.      A short summary of not more than 10 pages that refers to the chronological description of events.

                                                           vi.      A full detailed chronological description of events which refer to attached documentation, in format similar to below

1.      I met with Mr X . Minutes attached as X1

2.      I wrote a letter to DWAF stating….  Attached as X2

3.      DWAF replied ……. Attached as X3

4.      etc
